Welcome to Placement Kenya. These Terms of Service (“Terms”) govern your access and use of our platform, services, and related tools (collectively, the “Platform”). By creating an account or using the Platform, you agree to these Terms. Please read them carefully.

1. Overview of Placement Kenya

Placement Kenya connects tourism and hospitality professionals (“Talent”) with businesses, hotels, restaurants, and travel companies (“Employers”). The Platform provides a space to showcase skills, apply for opportunities, and facilitate recruitment. Placement Kenya is not an employer of Talent and does not guarantee job placements.

2. Eligibility

You must be at least 18 years old to use Placement Kenya.
By using the Platform, you confirm that the information you provide is accurate, complete, and up-to-date.
Employers must be legally registered businesses or individuals authorized to recruit.

3. User Accounts

Registration: Users must register to access the Platform. Employers must provide valid business details; Talent must provide accurate professional information.
Verification: Placement Kenya may request identity or business verification to maintain platform security.
Responsibility: You are responsible for maintaining the confidentiality of your login credentials. Any activity under your account is your responsibility.

4. Services Offered

For Talent: Create profiles, showcase skills, connect with Employers, apply for opportunities, and receive payments through approved channels (if applicable).
For Employers: Post opportunities, review profiles, engage Talent, and manage recruitment processes directly.
Platform Role: Placement Kenya facilitates connections but does not guarantee employment, project success, or payment outside agreed terms.

5. Fees and Payments

Placement Kenya may charge Employers service fees for posting jobs, accessing Talent, or using premium features.
Talent may be subject to service fees deducted from earnings on confirmed placements.
All fees are non-refundable unless stated otherwise.
Users are responsible for applicable taxes.

6. User Conduct

By using Placement Kenya, you agree NOT to:

Provide false, misleading, or fraudulent information.
Use the Platform for unlawful activities, discrimination, or harassment.
Circumvent payments, agreements, or communication outside the Platform.
Post inappropriate content, spam, or harmful material.

Violation may result in suspension or termination of your account.

7. Intellectual Property

Content you upload (profiles, resumes, job posts, etc.) remains yours, but you grant Placement Kenya a non-exclusive license to display, distribute, and promote it.
Placement Kenya trademarks, logos, and platform content remain our property. Unauthorized use is prohibited.

8. Dispute Resolution

Placement Kenya is not responsible for disputes between Employers and Talent.
We may, at our discretion, assist in resolving disputes but do not guarantee outcomes.
Users are encouraged to document agreements and communicate clearly through the Platform.

9. Limitation of Liability

Placement Kenya provides the Platform “as is” without warranties.
We are not responsible for job outcomes, payment disputes, or interactions between users.
Our liability to any user will not exceed the fees paid to Placement Kenya in the preceding 6 months.

10. Privacy and Data Use

Placement Kenya collects and processes personal data in line with our Privacy Policy.
By using the Platform, you consent to the collection, use, and storage of your information.

11. Termination

You may deactivate your account at any time.
Placement Kenya reserves the right to suspend or terminate accounts for violations of these Terms or harmful conduct.

12. Changes to Terms

Placement Kenya may update these Terms from time to time. Users will be notified of material changes. Continued use of the Platform indicates acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of Kenya. Any disputes arising will be resolved under the jurisdiction of Kenyan courts.
